Terms & Conditions

This is a translation of the Czech version. In case of any discrepancy, the Czech version prevails.

1. Introduction

1.1 The Outsider mobile application (hereinafter "Application") is operated by Ing. Martin Urban, with registered office at Voroněžská 2544/8, 616 00 Brno, Czech Republic, ID: 05861896, registered in the trade register of ŽÚ MMB (hereinafter "Operator").

1.2 These Terms and Conditions (hereinafter "Terms") govern the conditions of use of the Application and the relationship between the Operator and the users of the Application (hereinafter "User").

1.3 The Outsider Application is a mobile platform designed for playing outdoor puzzle and logic games using GPS navigation and movement in the field.

1.4 By downloading, installing, or using the Application, the User accepts these Terms in full.

1.5 The Operator reserves the right to unilaterally modify and update these Terms. The current version of the Terms is always available on the outsider.app website and in the Application.

2. Service Description

2.1 The Application allows Users to participate in outdoor games that use GPS technology to navigate to checkpoints where Users complete game tasks and solve puzzles.

2.2 Full use of the Application requires:

  • a mobile device with a functional GPS module,
  • internet connection (mobile data or Wi-Fi),
  • permission to access the device's location,
  • an active user account.

2.3 Some features of the Application may be subject to fees. Service prices are listed in the Application and may vary depending on the platform (iOS, Android).

3. Registration and User Account

3.1 A user account must be created to use the Application.

3.2 The User is required to provide truthful and current information during registration.

3.3 The User is responsible for maintaining the confidentiality of login credentials and for all activity performed under their account.

3.4 The User has the right to cancel their account at any time through the Application settings or by contacting the Operator.

4. Safety Rules and Liability Exclusions

4.1 Safety During Use

The User agrees to the following when using the Application:

a) Not to use the Application while driving a motor vehicle – Active use of the Application, navigation, and playing games while driving is strictly prohibited. Any use of the Application while driving is at the User's own risk, and the Operator bears no responsibility for damages caused by such conduct.

b) Pay full attention to the surrounding environment – The User is required to constantly monitor their surroundings, traffic, terrain, and other people. The Application must not distract from safe movement.

c) Comply with legal regulations and rules – The User is required to respect traffic regulations, land access rights, private property, nature conservation, and all applicable legal norms.

d) Respect the privacy of third parties – The User must not enter private property without permission or violate the privacy of other persons.

4.2 Weather Conditions and Natural Risks

a) The User uses the Application outdoors at their own risk and is fully responsible for assessing the suitability of weather conditions for outdoor activity.

b) The Operator is not liable for:

  • injury or health damage caused by adverse weather (storms, frost, heat, snow, ice, wind, etc.),
  • damage caused by natural elements,
  • injuries in difficult terrain,
  • consequences of hypothermia, overheating, or dehydration.

c) The User is required to adapt their activity to current weather conditions and to interrupt or postpone the game in adverse weather.

4.3 Physical Fitness and Health

a) Using the Application involves physical activity outdoors, including walking and movement over various types of terrain.

b) The User is responsible for assessing their own physical fitness and health status in relation to the planned activity.

c) The Operator is not liable for health complications, injuries, or health damage caused by physical activity while using the Application.

d) Persons with health limitations should consult their physician before using the Application.

4.4 GPS Accuracy and Navigation

a) The Application uses GPS technology, which may be affected by technical limitations, atmospheric conditions, buildings, or terrain.

b) The Operator does not guarantee 100% accuracy of GPS localization and navigation.

c) The User must not rely exclusively on the Application's navigation and should use their own judgment and common navigation skills.

d) The Operator is not liable for damages caused by inaccurate GPS navigation.

4.5 Technical Requirements and Availability

a) The Operator does not guarantee uninterrupted availability of the Application and reserves the right to perform maintenance, updates, or temporarily restrict access to the Application.

b) The Operator is not liable for technical problems, internet connection outages, or GPS malfunctions on the User's device.

c) Some features of the Application may require an active internet connection, which the User is responsible for providing.

4.6 General Liability Exclusion

a) The User uses the Application at their own danger and risk.

b) The Operator is not liable for:

  • any direct or indirect damages arising from the use of the Application,
  • loss or damage to the mobile device,
  • theft or loss of personal belongings during use of the Application,
  • damages caused by the actions of third parties,
  • health damage, injuries, or death arising in connection with the use of the Application.

c) The Operator is not liable for the content and accuracy of information provided within game content, puzzles, and tasks.

5. Rules of Conduct

5.1 The User agrees to:

  • use the Application in accordance with good morals and applicable legal regulations,
  • not damage the environment,
  • respect other users and game participants,
  • not interfere with the technical functioning of the Application,
  • not use unauthorized tools, bots, or automated systems,
  • not bypass the Application's security or exploit bugs in the Application.

5.2 The Operator has the right to block or cancel the account of a User who violates these rules or whose conduct could harm the Operator or other Users.

6. Intellectual Property

6.1 All rights to the Application, including design, content, logo, text, graphics, game content, and code, belong to the Operator or its licensors.

6.2 The User has no right to copy, modify, distribute, or otherwise misuse the content of the Application without the written consent of the Operator.

7. Payments and Refunds

7.1 Some features or content in the Application may be subject to fees.

7.2 Payments for paid content are processed through the Apple\u00a0App\u00a0Store or Google\u00a0Play\u00a0Store platforms in accordance with their terms and conditions.

7.3 Refunds for purchased content are governed by the rules of the respective platform (App\u00a0Store, Google\u00a0Play).

8. Personal Data Protection

8.1 The processing of Users' personal data is governed by the Privacy Policy, which is available at outsider.app/zoou_cs.

8.2 By using the Application, the User consents to the processing of their personal data as described in the Privacy Policy.

9. Final Provisions

9.1 These Terms are governed by the laws of the Czech Republic.

9.2 Any disputes between the Operator and the User shall be resolved primarily by agreement, otherwise by the competent courts of the Czech Republic.

9.3 If any provision of these Terms is invalid or ineffective, the remaining provisions shall remain in force.

9.4 The Operator reserves the right to change these Terms at any time. The User will be informed of changes through the Application or on the website.

9.5 These Terms and Conditions take effect on January 1, 2026.
